O-1 nonimmigrants are those persons who have extraordinary ability in the sciences, arts, education, business or athletics, which has been demonstrated by sustained national or international acclaim, and who are coming temporarily to the U.S. to continue to work in the area of extraordinary ability. O-1 status may also be granted to persons who have a demonstrated record of extraordinary achievement in motion picture and televison productions. Both types of O-1 cases must be supported by extensive documentation.

Under the regulations, extraordinary ability in the fields of science, education, business or athletics means a level of expertise indicating that the person is one of the small percentage who has risen to the very top of the field of endeavor.

Extraordinary ability in the field of the arts is evaluated in terms of distinction. Distinction means a high level of achievement in the field of the arts as evidenced by a degree of skill and recognition substantially above that ordinarily encountered to the extent that a person described as prominent is renowned, leading, or well-known in the field of arts.

Extraordinary achievement with respect to motion picture and television productions means a very high level of accomplishment evidenced by a degree of skill and recognition significantly above that ordinarily encountered to the extent the person is recognized as outstanding, notable or leading in the motion picture and/or television field.
