Employers can file 6 months before the new fiscal year begins. USCIS received ~124,000 H-1B petitions within the first few weeks of April, 2014, and Congress has made no changes to increase H-1B numbers. Chances are best therefore to have an H-1B petition filed close to April 1 prior to the beginning of the fiscal year.
